We at the Ardour Analytics Private Limited (“the Company/We/Our/Us/Fundly”) are committed to protecting the privacy of the information provider ("You/Your/Yourself/Customer"). We consider the privacy and protection of Your data/ information to be of high importance.

This Privacy Policy will familiarize You with the manner in which the Company may collect, use, share, transfer and disclose Your data/information. By using http://fundly.ai/ (the “website”) and Fundly+ (“android app/portal”), You consent to the terms of our privacy policy (“Privacy Policy”) in addition to Our terms and conditions to use Our Website (“General Website Terms”). We encourage You to read this Privacy Policy from time to time to keep Yourself updated with the changes & updated that We make to this Policy.

This Privacy Policy shall be construed to be provided in compliance with the Information Technology Act 2000 (“IT Act”) and applicable rules framed thereunder, as amended from time to time, and shall be read with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 (“SPDI Rules”), and Digital Lending Guidelines issued by Reserve Bank of India (“RBI”) as applicable.

Information we collect

Fundly uses the information collected from You or about You to provide Services to You. When You set up Your account on the Fundly portal, we collect Your personal information such as Your first and last name; Your home address or other physical addresses; email addresses; telephone numbers; identity information (like PAN, address proof, date of birth, gender), bank statement or Drug Licence, etc. (“ Account Opening Information ”). In addition, We also collect and store certain information including security-related information that You use to access Our Website/Portal in relation to Our Services (“ Account Information ”). In general, Fundly will use the information collected from You for the purposes for which You provided such information and as set out below.

Fundly may collect the following information (“Personal Information”) and you hereby explicitly consent to the following:

  • Account Opening Information and Account Information: Self-declared information like name, referral code used, email, address details, photo, address proof and identity proof. Additionally, for opening account with Our Financing Partner (Regulated Entity):
  • Self-employment details such as profession, monthly income etc.
  • SMS: We do NOT access/read any SMSs from Your mobile device.
  • Camera Access: We may require one-time access to Your mobile device camera for a seamless experience for clicking Your selfie and to upload photos for Your KYC compliance and/or for uploading any other necessary documents on the Portal.
  • Location: We currently do NOT store/track your geolocation from your mobile device. We may in due course of time, may seek location details, which would be taken only post obtaining prior permission from you in order to facilitate smoother and faster operational flow and prevent any fraudulent activities.
  • Contact: We do NOT collect any contacts from Your mobile device.
  • Installed Apps: We currently do NOT collect metadata information of apps installed on Your mobile device. In due course, We may periodically collect metadata information of apps installed on Your mobile device which includes the application's name, package name, installed time, updated time, version name and version code of each installed application on Your device to assess and provide personalised offers to you. Needless to say, We'll take explicit permission from you before doing that.
  • Transaction Information: The transaction information generated through the Fundly App will be stored and used by each of the Financing Partners (Regulated Entities) of Fundly.
  • Device Data : When You browse Our Website/Portal or apps, We also automatically receive Your devices' internet protocol (IP) address. This helps Us learn about Your browser and operating system, software, the date and time at which You visited the Portals, the type of device being used (including the hardware models), the browser being used, etc, same would help us detect and prevent fraud.
  • Storage: We may require this permission so that Your documents can be securely downloaded and saved on Your phone, and so You can upload any required documents easily for quicker approval and disbursal of credit facility. This helps in providing a smooth and seamless experience while using the Portal.
  • Feedback Data and Other Data: We may access and save data in the following instances:
  • When You contact Us or We contact You, We may record information provided by You to service You, or record calls for quality and training purposes;
  • When You participate in Our referral programs or use any discount codes offered by Us and input such data;
  • When You provide any feedback or comments to Us on the Portal or any other platform.
  • Third Party Information: We or the Financing Partner may also work closely with third parties (including, for example, credit information bureaus, account aggregators, business partners, technical sub-contractors, analytics providers, search information providers, etc.) and may lawfully receive information about You from such sources. Such data may be combined with data collected on the Portal and such other information as provided in this Policy. Such third party will provide same or equal protection to the user data as provided in this Policy.
  • You hereby expressly consent to Our access and use of Your aforesaid information, and disclosure of Your personal information in accordance with this Policy. We may require You to share further information on a later date to confirm the veracity of Your information or pursuant to any additional features added to the Portal.
  • You also consent to the Financing Partners for accessing your transaction information generated through your use of the Fundly Portal.

How We Use the Information we collect

  1. Open and update Your account on Fundly portal
  2. Establish and verify Your identity
  3. Provide Services, process service requests, and offer customer support
  4. Undertake research and development
  5. Facilitate credit assessment and personalised offers
  6. Analyse Your usage of the Portal and to improve the services/facilities on the Portal
  7. Deliver any administrative notices, alerts, advice, notifications and communication relevant to Your use of any of the facilities on
  8. the Portal through social media (including WhatsApp), SMS and other mediums
  9. Undertake market research, project planning and problem troubleshooting, and to protect against error, fraud or other criminal activity
  10. Disclose to governmental authorities, courts and regulatory laws or as otherwise required under any applicable laws or private contract
  11. Disclose to employees, agents and representatives on a need-to-know basis as part of the services
  12. Disclose to relevant and authorised financial service providers and Financing Partner who have partnered with Fundly for providing the
  13. loan facilities to the customers
  14. Facilitate in undertaking KYC authentication/compliance
  15. Assist in resolving disputes in relation to loan facilities made available by Financing Partners
  16. Disclose to the credit information bureau and such other authorities as may be required by applicable laws and
  17. Such other purposes as provided in this Policy

Notwithstanding anything contained, Fundly will have the right to collect and process transactions executed by the Customer through the Portal. Fundly may also be required to share Personal Information with its third-party contractors such as financial service providers, banks or NBFCs/Financing Partners. In such cases, Fundly shares the information securely and ensures that all personal information recipients comply with confidentiality, fidelity and secrecy obligations and sign covenants in this regard. Such third party will provide same or equal protection to the user data as provided in this Policy. At each and every stage of data sharing and storing explicit consent shall be acquired.

Fundly may make information available to third parties that are financial and non-financial companies, such as service providers, government agencies, courts, legal investigators, and other non-affiliated third parties as requested by You or Your authorized representative, or otherwise when required or permitted by law. No biometric data shall be stored/ collected in the systems associated, unless allowed under extant statutory guidelines.

In addition to registration, Personal Information may be asked for reporting a problem/complaint with Fundly. We may send You emails about Our Portal, new products, payment reminders and other updates. We may use the phone number provided and verified by You to reach out to You via call, WhatsApp and SMS. Fundly will ensure that Personal Information provided by You is treated securely, in accordance with the provisions of this Policy and the Rules. You are advised to refrain from posting personal information anywhere on the Portal, other than those specifically required by Fundly.

The account information and profile are PIN protected. Fundly will never ask for Your PIN through unsolicited phone calls or emails. However, if any person, claiming to be an authorized representative of Fundly, contacts You, We request You not to provide any information to such person and instead immediately contact Fundly as per the contact details provided in this Policy. Fundly shall not be liable for any loss of Personal Information provided to such persons. All data is stored only in servers located within India, while ensuring compliance with statutory obligations/ regulatory instructions.

Link to third-party websites

Our services may link to third-party websites and services that are outside our control. We are not responsible for the security or privacy of any information collected by websites or other services. You should exercise caution and review the privacy statements applicable to the third-party websites and services you use.

Representation and Warranties

  1. Your Personal Information will primarily be stored in an electronic form. However, certain data can also be stored in physical form.
  2. We may enter into agreements with third parties to store or process Your information or data. These third parties may have their own security standards to safeguard Your information or data and We will on reasonable basis require from such third parties to adopt reasonable security standards to safeguard Your information / data.
  3. Notwithstanding anything contained in this Privacy Policy or elsewhere, the Company shall not be held responsible for any loss, damage or misuse of your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event. A "Force Majeure Event" shall mean any event that is beyond the reasonable control of the Company and shall include without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption.

Right to Rectification

We will provide you with the right to review, access and modify the Personal Information that we maintain about you depending on technical feasibility and requirements of applicable laws. We may perform verification before providing you access to this Personal Information. However, we are not responsible for the authenticity of the Personal Information provided by you.

How do I Withdraw My Consent?

You have the right to withdraw the consent provided to us in relation to your Personal Information at any time in writing by sending an e-mail to us at grievance@fundly.ai , in accordance with the terms of this Privacy Policy. In case you do not provide your information or consent for usage of Personal Information or subsequently withdraw your consent for usage of the Personal Information so collected, the Company reserves the right to discontinue the services for which the said Personal Information was sought.

However, if You have availed any loan facilities from Our Financing Partner, the financing Partner shall have the right to continue processing Your information till such credit facility has been repaid in full, along with any interest and dues payable and/or for such period as may be allowed under applicable law.

Account deletion

You can request the Company to delete the Personal Information provided by you to the Company by sending an e-mail to us at connect@fundly.ai. However, please note that correction or deletion of certain information or data may lead to cancellation of Your registration with the Website/Portal or your access to certain features of the Website/Portal. You also agree and acknowledge that certain data or information cannot be corrected or deleted and/or is prohibited from being deleted under any applicable law or in lieu of law enforcement requests or under any judicial proceedings.

Policy regarding Children

We define children as individuals under the age of 18 years. This Portal is not intended for the use of children and Fundly does not knowingly solicit or collect information from children.

The cookies are either used to improve the quality of the Portals or for storing Your preferences as a user, improving search results and tracking user trends. The Company reserves the right to revise and update this Privacy Policy at its sole discretion. We have taken steps and adopted industry-standard security measures to maintain the safety of your Personal Information. All electronic financial transactions performed through our Website are covered by encryption technology.
